UK: Supreme Court Holds (overturning Court of Appeal) that Compensation under Data Protection Law Requires Proof of Damage

- Abstract
On 10 November 2021, the UK Supreme Court handed down its judgment in Lloyd v Google LLC [2021] UKSC 50, bringing to a close a protracted litigation that centered on the question: is the processing of personal data in breach of data protection law a matter the data subject should be compensated for per se, in virtue of their loss of control over the data, or must they go further and show that actual damage, such as financial loss or mental distress, resulted from the breach?
