In the Special Issue 2026 of GRUR Patent, the journal editors Gunnar Baumgärtel, Hermann Deichfuß, and Tim W. Dornis bring together a representative selection of English-language contributions from the journal’s 2025 issues.
The central focus is the consolidation of the Unified Patent Court (UPC), which has rapidly established itself as the primary forum for European patent litigation. Key themes include the growing body of UPC case law, SEP/FRAND issues, the UPC's expanding international reach following the CJEU's landmark decision in BSH v. Electrolux, and the development of patent mediation and arbitration. The issue is further rounded out by, among other contributions, an analysis of the Enlarged Board of Appeal's decision G 1/24 on claim interpretation.
The Special Issue offers practitioners and academics alike a concise orientation on the state of European patent law at a moment of profound institutional change.
