Fourth International Conference on Legal, Security and Privacy Issues in IT Law

Christian Krökel and Marcelo Corrales participated in the Fourth International Conference on Legal, Security and Privacy Issues in IT Law (LSPI) and the Third International Law and Trade Conference (ILTC) held in Sliema, Malta on 3rd-5th November 2009. The event was an interesting mixture of academics and other specialists coming from different backgrounds, including a number from different law firms.

Christian (picture above) discussed a topic on e-learning and data protection issues. The presentation dealt with privacy implications of so-called sociotechnical systems (STS) utilized at universities and other institutions of higher education under German and European Law. In particular, he focused on the compatibility of these systems with the principles of data protection as laid down in Directive 95/46/EC (data protection), Directive 2002/58/EC (data processing) and 2006/24/EC (retention of data) using the example of some widespread learning management systems. Particular emphasis was placed on the data subject's consent, serving as one way of protecting the individual's privacy.

 

Marcelo presented the topic entitled "Intellectual Property Rights in e-Health: balancing out the interests at stake; a Herculean task?" The presentation contained an analysis of the relevant intellectual property rights concerning e-health projects using Grid computing infrastructure within a clinical trials environment based on a European Integrated Project funded by the European Union project ACGT (Advancing Clinico Genomic Trials on Cancer). On 3rd November, in e-health projects using Grid infrastructure within a clinical trials setting, Marcelo set out two important issues at stake: Firstly which (intellectual) property rights arise during the course of such a project? and secondly which patient rights have to be regarded?"

Additionally, the two participants from Hannover enjoyed an invitation to the Old University Building in Valletta where the rector of the University, Professor Juanito Camilleri, received some chosen conference participants from institutions of higher education to discuss opportunities for future cooperation.
